Welcome to Trend Moose! The terms “we,” “us” and “our” refer to Trend Moose. We operate this store and website, including the related information, content, features, tools, products and services (the “Services”). Trend Moose is powered by Shopify.

These Terms of Service, together with the policies referenced below, describe the terms that apply when you use our Services or purchase from us.

Please read these Terms carefully. By accessing or using the Services, you agree to these Terms. Our collection and use of personal information are described in our Privacy Policy.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms excludes or limits consumer rights, warranties or remedies that cannot lawfully be excluded or limited.

SECTION 1 — ACCESS AND ACCOUNT

You must be at least the age of majority in your province, territory or state of residence to place an order or create an account.

You agree to provide accurate, current and complete information, including your contact details, payment information and shipping address. You must have the authority to use any payment method you provide.

You are responsible for protecting your account credentials and notifying us promptly of any suspected unauthorized use. You may not transfer or sell your account to another person.

SECTION 2 — OUR PRODUCTS

We aim to describe and display our products accurately. Colors and appearance may vary depending on your device and display settings. This does not affect your rights if a product is defective, materially different from its description or otherwise fails to meet applicable legal requirements.

Product availability, descriptions and prices may change. We may discontinue products or limit order quantities.

We work with third-party suppliers and fulfillment partners. Product availability, shipping origin and delivery eligibility vary by item. We do not represent that all products are manufactured, stocked or shipped in Canada or the United States.

SECTION 3 — ORDERS

Placing an order constitutes an offer to purchase. An automated order acknowledgement confirms receipt of your order but does not necessarily constitute acceptance.

We may decline or cancel an order because of unavailability, suspected fraud, payment problems, material listing errors or other legitimate reasons, subject to applicable law. If we cancel an order after collecting payment, we will refund the amount paid for the cancelled items.

If an order requires a material change, we will contact you about the available options rather than substitute a materially different product without your agreement.

Please review your order before submitting it. Contact us promptly if you need to request a change or cancellation. Changes may not be possible once processing or fulfillment has begun. Any mandatory cancellation rights remain unaffected.

Returns and refunds are governed by our Return and Refund Policy and applicable law.

Products are offered for personal or household use unless we agree otherwise.

SECTION 4 — PRICES AND BILLING

Prices and promotions may change before an order is placed. The applicable price and checkout currency are displayed before you submit payment.

Applicable taxes and any shipping charges collected by Trend Moose will be shown at checkout. Import duties, taxes or carrier clearance fees may apply separately as explained in our Shipping Policy.

Where currency conversion is involved, your bank or payment provider may apply its own exchange rate or fees.

You agree to provide accurate billing and payment information and authorize charges for the total amount displayed when you submit your order.

Promotions may have additional conditions disclosed with the offer. Those conditions apply to the promotion, subject to applicable law.

SECTION 5 — SHIPPING AND DELIVERY

We accept orders for delivery within Canada and the United States only. Some products may be available for delivery to only one of those countries or to particular eligible addresses.

Products may ship from domestic or international suppliers and warehouses, including locations outside Canada and the United States. Shipping origin, processing time and transit estimates vary by product and destination.

Orders containing multiple items may arrive in separate packages.

Delivery estimates are not guaranteed dates. If a shipment is delayed, missing, damaged or otherwise affected, contact us so we can investigate and provide an appropriate resolution.

Our Shipping Policy provides further details about destinations, shipping charges, tracking and import charges. Nothing in these Terms transfers responsibility or risk to you contrary to applicable law.

SECTION 6 — INTELLECTUAL PROPERTY

The Services contain materials owned by Trend Moose or used with permission from their respective owners, including text, graphics, logos, photographs, videos and other content.

You may use the Services for lawful personal, non-commercial purposes. Except as permitted by law or with the relevant owner’s permission, you may not reproduce, distribute, modify, sell or commercially exploit protected content.

All third-party trademarks and product names remain the property of their respective owners. Their appearance on our website does not by itself imply sponsorship or endorsement.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools or features supplied by third parties. These tools may be subject to the third party’s own terms and privacy policies.

We do not control every aspect of third-party tools and cannot guarantee their continuous availability or performance. Any limitations concerning these tools apply only to the extent permitted by law.

New features added to the Services are subject to these Terms unless separate terms are provided.

SECTION 8 — THIRD-PARTY LINKS

Our website may contain links to third-party websites. We do not control those websites or their content, security or privacy practices.

Please review the applicable terms and privacy policies before using a third-party website or purchasing directly from another business.

For products purchased from Trend Moose, please contact us for order assistance, even when a third-party supplier fulfills the order.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Trend Moose is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Trend Moose. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Trend Moose, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Trend Moose.

This section applies only to the extent permitted by applicable law and does not limit rights that cannot lawfully be waived.

SECTION 10 — PRIVACY POLICY

Our collection, use and disclosure of personal information are described in our Privacy Policy.

Because Shopify hosts our store and provides related services, Shopify also processes personal information. Information may be processed in countries other than your country of residence.

SECTION 11 — FEEDBACK AND REVIEWS

If you submit a review, photograph, suggestion or other content to us for publication, you confirm that you have the necessary rights to submit it.

You grant Trend Moose a non-exclusive, worldwide, royalty-free license to use, reproduce, display and reasonably format that content for operating and promoting our Services. This license does not transfer ownership of your content to us and remains subject to applicable privacy and other laws.

Reviews must reflect actual experiences. You must disclose any compensation or incentive connected with a review.

You may not submit unlawful, misleading, abusive or infringing content, malicious software or someone else’s private information without authorization.

We may moderate or remove content that violates these requirements. We will not edit a review to misrepresent the reviewer’s opinion.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

We may correct errors in descriptions, prices, promotions, shipping information or availability.

If an error materially affects an order you have placed, we will contact you about the correction and available options. If we cannot fulfill the order as agreed and it is cancelled, we will refund the applicable payment.

Corrections do not remove any rights you have under applicable law.

SECTION 13 — PROHIBITED USES

You may not use the Services to:

• Violate applicable laws or another person’s rights.
• Submit fraudulent orders or use unauthorized payment methods.
• Impersonate another person or provide deliberately misleading information.
• Harass, threaten or abuse customers, staff or other people.

• Collect personal information without authorization.
• Send spam or other unlawful communications.

You may stop using the Services at any time.

We may suspend or terminate access for a material breach of these Terms, suspected fraud, security concerns or legal requirements.

Termination does not remove obligations relating to existing orders, refunds or rights that accrued before termination.

Provisions that reasonably need to continue after termination, including intellectual property, dispute-related provisions and applicable limitations of liability, will remain in effect to the extent permitted by law.

SECTION 15 — WARRANTIES

We aim to provide accurate information and a reliable shopping experience, but we cannot guarantee that the website will always be uninterrupted, secure or free of technical errors.

To the extent permitted by law, the website and optional online tools are provided on an “as available” basis.

Nothing in these Terms excludes statutory product warranties or your rights concerning product quality, fitness, description, safety or other requirements imposed by applicable law.

Any additional product warranty expressly stated on a product page applies according to its terms.

SECTION 16 — LIMITATION OF LIABILITY

To the extent permitted by applicable law, Trend Moose will not be liable for indirect or consequential losses arising from use of the Services where those losses were not reasonably foreseeable.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

These limitations do not remove your rights to remedies for defective goods, non-delivery or other breaches where those remedies are required by law.

SECTION 17 — RESPONSIBILITY FOR MISUSE

To the extent permitted by law, you are responsible for losses directly caused by your unlawful use of the Services, infringement of another person’s rights or material breach of these Terms.

This provision does not require you to compensate us for losses caused by our own negligence, misconduct or breach of legal obligations.

SECTION 18 — SEVERABILITY

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

A delay or failure to enforce a provision does not waive the right to enforce it later.

These Terms, the policies referenced in them and any specific terms disclosed and agreed to at the time of purchase form the agreement relating to your use of the Services and purchases from Trend Moose.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.

SECTION 20 — ASSIGNMENT

You may not transfer your obligations under these Terms without our written agreement.

We may transfer our rights and obligations in connection with a legitimate business transfer, provided that the transfer does not reduce your mandatory rights or the obligations owed to you for existing orders.

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, subject to any mandatory consumer protection laws that apply where you reside.

Nothing in these Terms deprives you of protections or access to courts available to you under applicable law.

Headings are provided for convenience and do not change the meaning of these Terms.

We may update these Terms from time to time. The current version will be available on this page.

Changes apply prospectively and will not retroactively alter the terms of an existing order without your agreement, except where required by law.

Where required, we will provide notice of material changes.
